RCRA Regulation of PCB Wastes [RCRA 40 CFR 261.8]




According to 40 CFR 261.8, PCB-containing dielectric fluid, as well as electrical equipment containing such fluid, that is authorized for use and regulated under 40 CFR 761 and that is hazardous only because it fails the test for the Toxicity Characteristic for hazardous waste codes D018 through D043, is exempt from regulation under 40 CFR 261 through 265, and 40 CFR 268, 270, and 124. Such wastes are also exempt from the notification requirements of RCRA Section 3010.

However, PCB-containing dielectric fluid that otherwise displays a characteristic (D001 - D017), would be subject to both RCRA hazardous waste and TSCA regulations.
