50 Foot Buffer for Ignitable and Reactive Hazardous Waste [40 CFR 262.17]


Large quantity generators of hazardous waste (LQGs) are subject to the container management requirements at 40 CFR 265 Subpart I, including a requirement at 40 CFR 265.176 which states, “Containers holding ignitable or reactive waste must be located at least 15 meters (50 feet) from the facility's property line.”
What if you don’t have a suitable place to store ignitable and reactive wastes that meets this 50 foot (15 meter) requirement?
EPA has addressed this issue in the Hazardous Waste Generators Improvements Rule, LQGs will be able to accumulate ignitable and reactive wastes closer to the property line, provided written approval is obtained from the authority having jurisdiction over the local fire code. A record of the written approval must be maintained as long as ignitable or reactive hazardous waste is accumulated in this area.
This new option will be available in the federal regulations on May 30, 2017—the effective date of the Hazardous Waste Generators Improvements Rule. States that do not automatically adopt the federal rules are not required to adopt this new, less stringent regulation, so it will not take effect in those states unless the state adopts the rule.
